Surrogacy Insurance in Mexico: What It Covers (and What It Doesn’t)

That means helping families plan not just for the joyful moments, but for the practical realities that can arise in pregnancy, birth, and postnatal care. One of the most important parts of that planning is medical insurance.

Medical insurance is a vital layer of protection for surrogates and babies, and it can make a meaningful difference if complications arise. But like any insurance product, it is not a guarantee that every claim will be paid in every circumstance.

This blog explains what and who is insured, what medical insurance in surrogacy covers, how to think about it responsibly, and how we support intended parents to plan with confidence.

Surrogacy is deeply emotional, but you must also be practical. Medical care can be costly, especially if additional maternity support or neonatal care is required.

Insurance is a requirement in Mexico as part of the legal framework. By having insurance in place, it can:

  • Provide financial protection if medical complications arise
  • Reduce uncertainty for intended parents during an already intense period
  • Support continuity of care for surrogate and baby
  • Help families plan responsibly, rather than relying on best-case assumptions

Put simply: insurance is part of building a safer, more resilient journey.

It’s natural to assume that if a policy exists, a claim will be paid. But insurance doesn’t work that way.

All insurance products are governed by:

  • Policy wording and exclusions
  • Underwriting decisions
  • Definitions of what is “covered” and what is “excluded”
  • Claims processes and evidence requirements

That’s why we’re careful and transparent in how we discuss insurance with members. 

As part of our responsibility to oversee and safeguard our programmes, we routinely review all aspects of the services and protections provided to intended parents and surrogates, including insurance.

Our goal is always to set the standard: to secure the strongest, most appropriate cover available, to keep protection continuous throughout the journey, and to go over and above what’s expected.

We’ve worked with an insurance provider to create a bespoke arrangement that has been designed and underwritten specifically for MSJ’s surrogacy programmes. It is not a standard off-the-shelf product.

The policy is underwritten by an established and regulated insurance company in Mexico and has been specifically developed with MSJ to provide dedicated medical and life cover for surrogacy journeys. Additionally, the insurer has a contract in place with the hospital that confirms its underwriting of the MSJ policy with a dedicated doctor from the insurer to authorise the claims where required.

At a high level, the policy is designed to:

  • Support surrogate general medical and life cover during the journey
  • Provide newborn cover for non-routine care, including support for NICU-related costs
  • Provide cover for any pregnancy complications 
  • Offer clearer administration and ongoing support, so families aren’t left trying to navigate complex processes alone
  • Remove the need to make a large deposit payment on admission to the hospital for birth

This is a standard policy for all surrogates without variation, other than when a pre-existing condition applies. Key benefits include:

  • Cover specifically designed for surrogacy journeys
  • Surrogate General Medical cover up to MXN$5 million
  • Pregnancy complications cover up to MXN$5million
  • Newborn cover, for non-routine care, up to MXN$1.5 million including NICU
  • Enhanced certainty around policy administration and ongoing support
  • Cover for organ loss and compensation for it (a rare risk of any pregnancy)

Most births proceed without significant complications, and for most families there is no medical reason to expect NICU care. However, if it is required it can lead to significant sums, so having this in place provides peace of mind, especially as it also covers babies born prematurely.

Planning well is not about expecting the worst; it is about making sure the worst would be manageable. When taking out insurance we always recommend that our members:

  • Read the policy schedule, not just the summary, and ask us about anything that is unclear. We ask our intended parents to sign a declaration to acknowledge that they have read and understood it.
  • Understand the claims route before it is needed: who notifies the insurer, what evidence is required, and how MSJ supports the process.
  • Hold a contingency fund for any unexpected costs that may fall outside of the policy.
  • Take independent legal advice on your agreement, including the insurance provisions. We build this into our pathway rather than treating it as optional.
  • Understand what excess and co-payments are due in event of a claim together with what the benefit limits are, so you understand the maximum payable by you vs the insurer in the event of a claim

Does insurance cover surrogacy in Mexico? 

MSJ provides every surrogate on its Mexico programme with a bespoke policy for surrogacy, that includes life and medical cover as well as covering pregnancy complications and NICU, if required.

What does MSJ’s surrogacy insurance cover? 

General medical and life cover, pregnancy complications cover, and newborn emergency cover. Routine standard delivery is not covered under the insurance but is payable as part of our standard hospital package.

Please note that it doesn’t cover the costs of any routine care or the costs of IVF treatment.

Why is cover for organ loss important? 

This is a rare risk of any pregnancy but including this cover in the insurance gives our surrogates peace of mind that in the event it should happen, the cost of the treatment as well as compensation for the loss is covered. For intended parents it means that the financial costs of this, which would be their responsibility to cover, is covered by the insurance. 

What happens if the baby needs NICU care? Newborn cover applies from birth and includes NICU admission and treatment up to the sum insured. MSJ’s Mexico team supports the family through the claim, including gathering the medical evidence the insurer requires.

Is the surrogate covered after birth? Yes. Cover runs for up to 6 months post birth, with an option to extend for a further 3 months if required, for any remaining benefit amount.

While no insurance product can cover every eventuality, our bespoke policy is designed to give members greater protection and greater confidence that, should the unexpected happen, they have appropriate financial support in place for insured, non-routine care.

Surrogacy asks a lot of everyone involved – emotionally, financially, and practically. Our responsibility is to meet that with compassion and transparency.
