Surrogacy in Mexico

At My Surrogacy Journey, we recognised that there was a need to provide our members with a safe pathway for international surrogacy. We spent time with fertility and medical professionals and a specialist human rights lawyer, all in Mexico City, to develop the Mexico City pathway for intended parents. We decided to launch a physical operation in Mexico City, and we’re proud to  have our own team of professionals and experts in our offices in Polanco.

We only work with the best partners in Mexico City – all medical and fertility professionals, lawyers and even the British Consul at the Embassy in Mexico City, to ensure our pathway is the safest and most efficient option for British intended parents who are choosing this route to parenthood.

A typical Mexico City journey takes under 18 months, which is to the point you return home to the UK with your baby.

Our pathway is:

  • An inclusive destination, available for everyone
  • An option for people with a cost point
  • Ethical and non-exploitive
  • Able to match you to a medically screened surrogate in 12 weeks
  • Aiming for an embryo transfer by month 5

Mexico City Pathway - Intended Parent Criteria

To meet our criteria for the Mexico City pathway, Intended Parents must:

  • Be aged under 55 for single or combined age of under 110 for a couple

  • Have the ability to get legal status in the country you are returning to

  • Have a medical reason surrogacy is needed (psychological or physical)

  • Have no relevant criminal convictions

  • Participate in psychological evaluation

  • Participate in a social & economic assessment

Pre-birth orders in Mexico City

A pre-birth order is an agreement that the surrogate and the intended parent(s) sign before the child is born which is presented to the Mexico City judge. The document declares that the intended parent(s) are the legal parent(s) of the child, and that the surrogate is not a parent and a surrogate.

For the state of Mexico City, after such an agreement is signed, the hospital where the child is born is required to write the names of the intended parent(s) onto the birth certificate for the child.

When combined with a pre-birth order, gestational surrogacy gives the intended parent(s) a complete guarantee that their parentage is fully settled in the eyes of the law in Mexico.

Will the surrogate be listed as a parent on the birth certificate?

Mexico City can list the surrogate as a surrogate, which is a unique situation. There are two elements to the birth. The first is the acknowledgment of the birth which lists the surrogate as a surrogate, along with the birth details. The second part of the birth certificate is the official birth certificate, and this lists the intended parents as the parents and does not mention the surrogate.

The Exit Process – Returning Home with Your Baby

Mexico City is still a relatively new destination for British IPs, and whilst surrogacy has existed in other parts of Mexico for several years, we’re working with its legal and clinical partners to #SetTheStandard of surrogacy in Mexico City, including the exit and passport process. The typical wait time post birth is between 2-3 months. This is mainly due to the Mexican passport being issued to British intended parents.

Caring for Your Surrogate in Mexico

The safeguarding, education and health of your surrogate is at the heart of what we do. The wellbeing of any woman will not be compromised in the pursuit of a surrogacy agreement.

All surrogates reside in Mexico City or Mexico state and they each will be represented legally by a specialist human rights lawyer to ensure there is zero exploitation or coercion involved in their decision making to be a surrogate.

Medical screening and background checks will take place to protect the safety of all women choosing to be a surrogate.  We are one of the few agencies that medically screen any surrogate before they are matched to you, reducing any unnecessary delays to your journey but also supporting the surrogate with any medical issues that may arise in their medical process.
