In Support of the Surrogacy Law Reform 2023 – A New Era for Surrogacy in the UK, My Surrogacy Journey (MSJ) proudly stand in full support of the proposed Surrogacy Law Reform 2023. This long-awaited reform represents a progressive, ethical, and compassionate framework that aligns directly with our mission to provide inclusive, empowering, and secure pathways to parenthood through surrogacy.

We believe that family-building should be safe, dignified, and legally protected for all involved: intended parents (IPs), surrogates, and children. The current legal system is outdated and unnecessarily complex. The Surrogacy Law Reform offers a modern, fit-for-purpose legal structure that reflects the lived experiences and needs of today’s families.

Why This Reform Matters

1. It aligns with our mission: to redefine surrogacy with dignity, clarity, and equality

MSJ are committed to improving outcomes and experiences for everyone involved in the surrogacy journey. The new law provides legal clarity, early parenthood recognition, and stronger protections for surrogates and IPs—values that have long guided our service and ethical framework.

2. It respects the autonomy and rights of surrogates

The proposed law acknowledges surrogates as empowered individuals who enter into agreements with full understanding and informed consent. Surrogates remain in control of their bodies and choices throughout, while also gaining stronger legal protection and recognition. We believe this reflects the commitments within our ethical framework to autonomy, nonmaleficence, and justice.

3. It removes uncertainty for Intended Parents

The current post-birth legal process often causes anxiety and disruption for IPs. The reform’s recommendation for pre-birth parenthood orders, when all criteria are met, means that IPs can be recognised as legal parents from birth—providing certainty, stability, and emotional security for everyone, especially the child.

4. It puts the child at the centre

This reform is rooted in the best interests of the child, ensuring that the child is born into a legally recognised, stable family environment. This principle mirrors our unwavering commitment to the long-term welfare and security of the children born through surrogacy.

5. It reflects how families are formed today

Modern families are diverse. Whether heterosexual, LGBTQ+, or single parents, people are increasingly building families through surrogacy. The proposed law embraces this inclusivity, ensuring all families have equitable access to legal recognition and support.

We urge lawmakers, professionals, and the wider public to support the implementation of the Surrogacy Law Reform 2023. This is not just a legal update—it is a recognition of the humanity, complexity, and love at the heart of every surrogacy journey.

The reform honours the emotional labour of surrogates, provides clarity and reassurance to intended parents, and protects the lifelong interests of the children born through surrogacy. It reflects what we already know through lived experience: that ethical surrogacy works best when it’s based on trust, transparency, and timely legal support.
