Is surrogacy legal in Mexico City?
Yes! Surrogacy is legal in Mexico following a Supreme Court decision on June 3rd, 2021. However, not all Mexican states have adopted the court’s mandate. This is why My Surrogacy Journey only works in surrogacy friendly states, where the state law recognizes surrogacy and surrogates are listed as a gestational carrier on the original medical certificate and not ‘a mother’. Ensuring the ethical and legal protection of both intended parents and surrogates is one of our highest priorities, so we only work with highly experienced, independent human rights specialists and leading surrogacy lawyers in Mexico City who have an exceptional understanding of reproductive legislation and family law.

In addition, all of our surrogates complete extensive background checks before being matched with intended parent.

Intended Parents
Family building for intended parents via domestic and cross boarder surrogacy has evolved rapidly, and so have the costs. Since the pandemic, surrogate availability in the US has not fully recovered. This has led to a significant increase, in some cases of over 60%, of surrogate and egg donor compensation, the cost of IVF, and surrogacy agency fees. The drastic inflation of these costs has created something we’re calling ‘financial infertility’. We need to challenge this.
The USA has a secure surrogacy framework, but for many pursuing a domestic journey is cost prohibitive – the average journey now costs around $200,000. Little is known about other destinations, but we’re here to change that. We want to help you decide by providing you with fact checked advice and clinical support.

Why Mexico City for surrogacy?
Everyone should be able to choose how they build their family. We believe this is a fundamental right when planning your most important life event. With rising costs of fertility treatment and third-party reproduction in the US, fertility treatment for many Americans is simply out of reach. Third party reproduction costs, particularly surrogacy agency fees, are on the rise in the United States, and they’re showing no sign of slowing down. Most intended parents will pay an average of $200,000 to have one child in the USA. As result, My Surrogacy Journey believes we are now witnessing people experience financially infertility, due to the rising costs of trying to build a family.

Intended Parent Criteria
To meet our criteria for the Mexico City pathway, Intended Parents must:
- Have a combined age of under 100 for a couple, or under 55 years old for a solo intended parent
- Have the ability to get legal status in the country you are returning to
- Have a medical reason surrogacy is needed (psychological or physical)
- No relevant felony charges or misdemeanours
- Participate in a psychological evaluation
- Participate in a social & economic assessment

Our priority was to create a safe pathway available to everyone – no matter your sexual orientation or HIV status. The pathway needed to be ethical, non-exploitative, and legally robust. This reflects in the partners we have engaged, including a specialist human rights lawyer working to protect women in Mexico City. In fact, all the lawyers that support our intended parents and surrogates are independent of our agency and all are experts in reproductive injustice. Meaning everyone is in the safest pair of hands.
Before launching this program in 2022 we physically met with every single partner in Mexico City. We have partnered with the top medical and fertility professionals, Mexican and American lawyers and even have relationships inside the US Embassy in Mexico City. All of this is to ensure our pathway is the safest and most efficient option for American intended parents who are choosing this route to parenthood.
